Terms of Service

1. Acceptance

By accessing or using HotSpotz websites or applications, you agree to these Terms of Service (“Terms”). If you do not agree, do not use HotSpotz.

2. Eligibility and accounts

You must be able to form a binding contract to create an account. You are responsible for your credentials and for activity under your account. Provide accurate information and keep it updated. Notify us if you believe your account has been compromised.

3. What HotSpotz provides

HotSpotz helps people discover places to go and things to do, including browsing nearby businesses, viewing offers, saving favorites, saving offers, and leaving star ratings. Businesses may maintain listings and offers through the Business Portal subject to separate Business Terms and product rules.

4. Acceptable use

You agree not to:

• Misuse HotSpotz, attempt unauthorized access, or disrupt the service
• Scrape, harvest, or overload systems beyond ordinary use
• Post or transmit unlawful, harassing, fraudulent, or infringing content
• Manipulate ratings, favorites, or engagement in a deceptive way
• Impersonate others or misrepresent your affiliation
• Use HotSpotz to spam, phish, or distribute malware

5. Business information and offers

Place pages, hours, menus, prices, offers, and related details are provided by businesses or otherwise sourced for discovery. HotSpotz does not guarantee that any business is open, that an offer is still available, that prices or hours are current, or that you will be satisfied with a third-party business. Confirm details directly with the business when it matters.

Offers

Offers are promotional content from businesses. Redemption terms are between you and the business. HotSpotz is not responsible for a business’s failure to honor an offer.

6. User content

If you submit content (such as ratings or profile information), you grant HotSpotz a non-exclusive license to host, display, and use that content to operate and improve the service. You represent that you have the rights needed to submit it.

7. Intellectual property

HotSpotz branding, software, and site materials are owned by HotSpotz or its licensors. You may not copy or reuse them except as allowed by these Terms or with written permission.

8. Availability

We aim to keep HotSpotz available, but we do not guarantee uninterrupted or error-free operation. Features may change. Temporary outages, maintenance, and content moderation may occur.

9. Suspension and termination

We may suspend or terminate access if we believe you violated these Terms, created risk for HotSpotz or others, or as required for security or legal reasons. You may stop using HotSpotz at any time. Account status controls (such as paused login) may be applied by HotSpotz operations.

10. Disclaimers

HotSpotz is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy of third-party business information.

11. Limitation of liability

To the fullest extent permitted by law, HotSpotz and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of HotSpotz. Our aggregate liability for claims relating to HotSpotz will not exceed the greater of amounts you paid to HotSpotz for the service in the twelve months before the claim or fifty U.S. dollars ($50), except where prohibited.

12. Changes

We may update these Terms and will post the updated version with a revised date. Continued use after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires otherwise.
